WAIVER AND ASSUMPTION OF RISK

WARNING: This waiver and assumption of risk contains a release and waiver of liability (limiting, among other things, your right to sue)

IN CONSIDERATION of Access Roadside Assistance Ltd. and any of its affiliates (collectively, the “Company”) permitting my access to and use of the property situated at 4740 190 Street, Surrey, British Columbia, V3Z 1B2 (the “Property”), for the purpose of purchasing and obtaining salvaged vehicles including all ancillary or related activities, or for any other purpose, I irrevocably agree (for myself and my kin, heirs, executors, administrators, assigns and successors) as follows:

THIS IS A RELEASE OF YOUR RIGHTS, READ IT CAREFULLY AND UNDERSTAND ITS PROVISIONS BEFORE INITIALING AND SIGNING

1. I am aware that there is danger, hazard and risk of injury or loss in connection with my access to and use of the Property, both foreseeable and unforeseeable, which include, but are not limited to, serious personal injury, death, property theft or damage, changing weather conditions, changes or variations in the land terrain, impact or collision with other people, equipment and/or other objects or physical structures, exposure to sun, dirt, algae, gems, mold, bacterial, viral and fungal agents and other pathogens, misuse or malfunction of equipment and negligence of other occupants of the Property including but not limited to the negligent use of firearms by other occupants of the Property, and negligence on the part of the Company, including the failure of the Company to take reasonable steps to safe guard or protect me, my kin, heirs, executors, administrators, assigns and successors, or any other person for whom I am at law responsible, from the risks, danger and hazards involved with my access to and use of the Property including but not limited to those referred above and, furthermore, while protective equipment and personal discipline may reduce the risks, danger and hazards referenced above, these risks, danger and hazards still do exist and are considerable.

2. I freely accept and agree to assume all risk of personal injury, death and property damage or loss connected with my access to and use of the Property howsoever arising, including (a) conditions on or about the Property, the operation or specifications of the equipment, transportation and any other operations associated with the Property, (b) actions, omissions or negligence (including failure to use reasonably prudent and careful care, and failure to protect me or any participant from risks, dangers and hazards inherent in my access to and use of the Property) of the Company, other lessors of the Property and all of their respective affiliates, successors and assigns, and all of the Company’s respective staff, directors, officers, volunteers, employees, contractors, agents and other representatives (collectively, the “Releasees”), and (c) any breach of any other duty imposed by law, by equity or by agreement of all or any of the Releasees

3. I accept and agree that if provided with equipment in connection my access to and use of the Property, the equipment shall be considered “as-is”, and I accept full responsibility for the care of the equipment while it is in my possession. I agree that I am responsible for the full replacement value of any equipment not timely returned, and I agree to pay for any damage to the equipment that exceeds normal wear and tear.

4. I hereby waive, release and forever discharge the Releasees from and against any and all manner of liabilities, claims, demands, suits, damages (including direct, indirect, special, punitive, incidental and consequential damages), costs, expenses, debts, actions and causes of action of any kind or nature whatsoever, including those of loss, damage, injury or death howsoever arising and further including those described in paragraph 2 (all, “Claims”) that I have, may have, or have ever had resulting from or connected in any way with my access to and use of the Property including, but not limited to, anything arising after the date of this document.

5. I assume full responsibility for any Claims (a) for damage or destruction to property I cause and (b) of myself or any third parties, in each case relating to my access to and use of the Property (including as described in paragraph 2) and I will fully defend, and hold harmless the Releasees and indemnify the Releasees for the full amount of any and all judgments, liabilities, payments, interest, costs, or other charges of whatever kind the Releasees or anyone or more of them incur as result of any such Claims.

6. I hereby authorize the Company and/or its personnel to call for my medical care or to transport me to a medical facility or hospital if, in the opinion of the Company’s personnel that medical attention is needed. I agree that this does not create a responsibility of the Releasees for my medical care. I will pay, and indemnify the Releasees, all costs associated with any medical care that is provided for me.

7. I acknowledge and agree that I am not employed by the Company, and that my access and use of the Property is voluntarily without expectation or promise of compensation of any kind and that no insurance or similar coverage will be provided by the Company to me in relation to my access or use of the Property or otherwise. To the extent any benefit or coverage is in fact directly or indirectly provided, it is on a purely discretionary or voluntary basis by the Company without any expectation of the same from myself.

8. I acknowledge and agree that (a) the word “including”, as used herein, is not limiting, (b) this waiver shall be governed and administered pursuant to the laws of British Columbia, and (c) I fully understand, and have been provided the opportunity to seek legal counsel in connection, with this document, which includes, among other terms, a waiver of my rights.

IN CONSIDERATION of Access Roadside Assistance Ltd. and any of its affiliates (collectively, the “Company”) permitting my access to and use of the property situated at 44027 Heritage Lane, Ile des Chenes, Manitoba, R0A 0T3 (the “Property”), for the purpose of purchasing and obtaining salvaged vehicles including all ancillary or related activities, or for any other purpose, I irrevocably agree (for myself and my kin, heirs, executors, administrators, assigns and successors) as follows:

THIS IS A RELEASE OF YOUR RIGHTS, READ IT CAREFULLY AND UNDERSTAND ITS PROVISIONS BEFORE INITIALING AND SIGNING

1. IN CONSIDERATION of Access Roadside Assistance Ltd. and any of its affiliates (collectively, the “Company”) permitting my access to and use of the property situated at 12 Peters Avenue, Martensville, Saskatchewan, S0K 0A2 (the “Property”), for the purpose of purchasing and obtaining salvaged vehicles including all ancillary or related activities, or for any other purpose, I irrevocably agree (for myself and my kin, heirs, executors, administrators, assigns and successors) as follows:

THIS IS A RELEASE OF YOUR RIGHTS, READ IT CAREFULLY AND UNDERSTAND ITS PROVISIONS BEFORE INITIALING AND SIGNING

1. I am aware that there is danger, hazard and risk of injury or loss in connection with my access to and use of the Property, both foreseeable and unforeseeable, which include, but are not limited to, serious personal injury, death, property theft or damage, changing weather conditions, changes or variations in the land terrain, impact or collision with other people, equipment and/or other objects or physical structures, exposure to sun, dirt, algae, gems, mold, bacterial, viral and fungal agents and other pathogens, misuse or malfunction of equipment and negligence of other occupants of the Property including but not limited to the negligent use of firearms by other occupants of the Property, and negligence on the part of the Company, including the failure of the Company to take reasonable steps to safe guard or protect me, my kin, heirs, executors, administrators, assigns and successors, or any other person for whom I am at law responsible, from the risks, danger and hazards involved with my access to and use of the Property including but not limited to those referred above and, furthermore, while protective equipment and personal discipline may reduce the risks, danger and hazards referenced above, these risks, danger and hazards still do exist and are considerable.

I freely accept and agree to assume all risk of personal injury, death and property damage or loss connected with my access to and use of the Property howsoever arising, including (a) conditions on or about the Property, the operation or specifications of the equipment, transportation and any other operations associated with the Property, (b) actions, omissions or negligence (including failure to use reasonably prudent and careful care, and failure to protect me or any participant from risks, dangers and hazards inherent in my access to and use of the Property) of the Company, other lessors of the Property and all of their respective affiliates, successors and assigns, and all of the Company’s respective staff, directors, officers, volunteers, employees, contractors, agents and other representatives (collectively, the “Releasees”), and (c) any breach of any other duty imposed by law, by equity or by agreement of all or any of the Releasees

3. I accept and agree that if provided with equipment in connection my access to and use of the Property, the equipment shall be considered “as-is”, and I accept full responsibility for the care of the equipment while it is in my possession. I agree that I am responsible for the full replacement value of any equipment not timely returned, and I agree to pay for any damage to the equipment that exceeds normal wear and tear.

IN CONSIDERATION of Access Roadside Assistance Ltd. and any of its affiliates (collectively, the “Company”) permitting my access to and use of the property situated at 128 Copper Road, Whitehorse, Yukon, Y1A 2Z6 (the “Property”), for the purpose of purchasing and obtaining salvaged vehicles including all ancillary or related activities, or for any other purpose, I irrevocably agree (for myself and my kin, heirs, executors, administrators, assigns and successors) as follows:

THIS IS A RELEASE OF YOUR RIGHTS, READ IT CAREFULLY AND UNDERSTAND ITS PROVISIONS BEFORE INITIALING AND SIGNING

1.
